Secretary Pena, as part of confirmation hearing testimony, pledged to continue Secretary O'Leary's program of "zero tolerance for reprisal" in DOE. Please remind him of that in your correspondence to him. Carson's elected representatives, Congressman John Duncan and Senator Fred Thompson, have followed Carson's situation with active interest for some time. They, along with Secretary Pena, are the most important public officials to contact. A letter would work better than an email. Additionally, a phone call to Ms. Pat Thompson at Congressman Duncan's Knoxville office (phone 423-523-3772, FAX 423-544-0728) and/or Ms. Cynthia Lemons at Senator Thompson's Knoxville office (423-545-4253; FAX 423-545-4252) would help.


Ask the officials to do the following:

To Help Joseph P. Carson, P.E.:

  • DOE should accept Joe's settlement proposal in order to make a public resolution of his allegations in the DOE Office of Hearings and Appeals, the process which Pena himself says is fair and protective of whistleblowers. (DOE's Whistleblower Protection Program)

  • DOE should delay Joe's reassignment to Washington DC until the resolution process has occurred or until May 1, 1998, so that Joe can request a "stay" from the appropriate legal forum if DOE refuses to use its own process to resolve the matter.


    To Help DOE's Employees, Its Neighbors, and America

    • DOE should adopt a "safety conscious work environment" where concerned workers are encouraged to voice safety concerns and DOE's own safety professionals have access to a DPO (Differing Professional Opinion) process, like the NRC allows. (Petition for "Safety-Conscious Work Environment" in DOE)

    • DOE should collaborate with the independent organizations which license or certify many of its safety professionals to improve their accountability for competency and ethics in DOE and in their professional communities. (Code of Ethics for Engineers)
